Legislative Alert: Updates to Hawai’i’s Uniform Controlled Substance Act

July 25, 2018

On July 11, 2018, Governor David Ige signed HB 2384 and HB 2385, both of which update the Uniform Controlled Substances Act and are titled "Relating To The Uniform Controlled Substances Act".

Introduced by Representative Scott Saiki in January 2018, HB 2384 allows prescription drugs to patients undergoing medically managed withdrawal, also known as detoxification treatment and maintenance treatment, by practitioners who are properly registered. It had been amended twice.

HB 2385, introduced by Saiki at the same time, updates chapter 329 of the Hawai'i Revised Statutes to make it consistent with amendments in the federal Controlled Substances Act as required under section 329-11, HRS. This had been amended three times before going to the Governor.

Both of these took effect immediately.
