Harassment and discrimination in the workplace are receiving ever-growing attention in the media and public eye.

It is incumbent on businesses, and the individuals who lead them, to know the laws that govern these kinds of behaviors, to establish policies and procedures to ensure the laws are followed by their workforces, and to create mechanisms for responding in the event of wrongdoing. For better or worse, there are numerous state and federal laws that apply in a variety of often overlapping and contradictory ways, creating a complicated minefield of legal exposure that can only be mitigated with knowledge and expertise.

This webinar is intended to provide an overview of that minefield, so that participants can begin to map out the safest and most compliant path forward for themselves, their workforces, and their companies. It will also identify the key laws in place, define and explain the crucial legal terms and concepts, and provide real-world tools for mitigating legal risk. Finally, it will also help hone best practices for responding to claims of harassment or discrimination, and will include concrete, practical examples highlighting common pitfalls, and ways to avoid them.

Zachary Rothenberg

Zachary Rothenberg (he/him) serves as “outside general counsel” and legal advisor to behavioral health businesses, including residential and outpatient treatment centers, sober living environments, and ancillary businesses such as billing companies, laboratories, psychology and psychiatry practices, and the like.

Zach regularly represents behavioral health clients in litigation matters, in state and federal courts and in arbitration, in matters relating to contract disputes, reimbursement matters (against commercial and government payors), employment matters, zoning and land use disputes. Zach also provides regulatory compliance advice on matters relating to marketing and business development, payor audits, claw-backs, and overpayment demands, and EKRA issues, among others.

Zach is a regular presenter at regional and national conferences within the behavioral health community, including most recently at the Treatment Center Investment & Valuation Retreat.

Lindsay Ryan

Lindsay Ryan (she/her) is committed to providing reliable counsel to strategically solve client matters and address their litigation needs.

Clients rely on Lindsay to develop solutions and effective arguments with respect to their complex legal challenges. Her practice focuses on advising employers on compliance with both state and federal requirements for disability accommodation, leaves of absence, wage and hour, harassment and discrimination complaints, workplace investigation, reductions in force, disciplinary actions and terminations. She represents clients in all forums, including state and federal courts, arbitration and administrative agencies. Furthermore, Lindsay partners with clients to provide ongoing management training seminars, draft employee policies handbooks and employment agreements.

Lindsay frequently presents webinars on employment law developments and is often cited in regional and national media outlets on topical employment issues, including those related to COVID-19 and the workplace.
